הוועדה למתן היתרים

בשנת 1977 החליטה ממשלת ישראל לאמץ כללי אתיקה שמטרתם מניעת ניגוד עניינים של שרים וסגני שרים, המבוססים על המלצות ועדה ציבורית בראשות השופט בדימוס שלמה אשר. בעקבות המלצות ועדה בראשות השופט מקס קנת, הוקמה בשנת 1980 הוועדה למתן היתרים, שבסמכותה לתת היתר אישי לחריגה מכללי האתיקה. הוועדה פועלת במסגרת משרד מבקר המדינה, והוא ממנה את שלושת חבריה, ובראשם שופט בדימוס. ד"ר יצחק קיסטר, שופט בית המשפט העליון בדימוס, מונה ליושב ראש הראשון של הוועדה.

החלטות הוועדה עוסקות בנושאים הבאים:

  • המשך כהונה של שרים בגופים כגון עמותת הנצחה, תזמורת או איגוד ספורט.
  • המשך כתיבת מאמרים, ספרים ומחקרים, מתן הרצאות עבור גורמים שונים או קבלת תגמולים עבור כתבים שפורסמו קודם לתחילת הכהונה.
  • נסיעות לחו"ל על חשבון גורם שאינו חלק ממוסדות המדינה וקבלת תרומות.
  • ניהול כספים, אחזקות בניירות ערך ונושאים כספיים אחרים כגון מתן הנחיה חד פעמית לחברת הנאמנות, המשך החזקת מניות בחברות פרטיות ועוד.

עד סוף 2018 קיבלה הוועדה כ-140 החלטות. החל משנת 2011 החלטות הוועדה מתפרסמות באתר האינטרנט שלה.[1] החלטות בנושאים רגישים מתפרסמות באופן חלקי או תוך השמטת פרטים.

דוגמאות להחלטות הוועדה:

  • השר יואב גלנט ביקש לאשר לו לקבל מאיש העסקים רמי אונגר שני כרטיסי כניסה למשחק הגמר של מונדיאל 2018, ששוויים 2,200 דולר. הוועדה אישרה את קבלת המתנה, בתנאי שהשר גלנט יתרום 10,000 ש"ח. השר ייעד את התרומה לארגון המסייע לחיילים בודדים.[2]
  • אושרה בתנאים מגבילים בקשתו של שר בממשלה לקבלת היתר להמשך שותפותה של רעייתו בחשבון בנק על שם אמה, כדי לאפשר לרעיה לבצע פעולות לטובת האם בלבד, במקרה חירום בלבד. למניעת פגיעה בפרטיות פורסמה ההחלטה ללא זיהוי השר.[3]
  • סגן השר הרב מנחם אליעזר מוזס ביקש לאשר לו לצאת לסיור במוסדות יהודיים בקופנהגן, על פי הזמנת הקהילה היהודית שם ובמימונה. הוועדה ראתה בהזמנה זו מתנה, כהגדרתה בחוק שירות הציבור, ועל כן יש לפעול לפי חוק זה, והדיון בבקשה אינו בסמכות הוועדה.[4]

במהלך הדיון בהחלטה נשמעת עמדתו של השר והוועדה מתחשבת בה, ובדרך כלל החלטות הוועדה הן סופיות, כאמור בכלל 21(ב) לכללי פעולתה של הוועדה.[5] חריג מנורמה זו היה הטיפול בבקשתו של ראש הממשלה, בנימין נתניהו, להסתייע בבן דודו, נתן מיליקובסקי ובחברו, ספנסר פרטרידג', לצורך מימון הוצאותיו המשפטיות. בשלב ראשון דחתה הוועדה את טענת נציגי נתניהו, שהחלטה בשאלה זו אינה בסמכותה.[6] בהמשך לכך דנה הוועדה בבקשה, והחליטה לדחות אותה.[7] בעקבות החלטה זו הגיש נתניהו לוועדה בקשה לדון מחדש בבקשתו לקבל סיוע למימון הוצאותיו המשפטיות. הוועדה החליטה לדחות את בקשתו.[8] נתניהו עתר לבג"ץ נגד החלטות אלו,[9] ונפסק שהוועדה תקיים דיון נוסף שבו יציג בפניה נתניהו פרטים נוספים, לשם קבלת החלטה חדשה בעניינו.[10] ימים אחדים לפני החלטת בג"ץ התפטר מתפקידו יו"ר הוועדה, השופט בדימוס ד"ר עוני חבש, ונימק זאת ב"לחצים פוליטיים".[11] בעקבות ההתפטרות מונה ליו"ר הוועדה השופט בדימוס שלום ברנר, שכיהן כיו"ר הוועדה גם בשנים 2001–2004.[12] בספטמבר 2019 מבקר המדינה, מתניהו אנגלמן אישר לנתניהו לקחת הלוואה, בתנאי שוק, מספנסר פרטרידג', בנימוק שהלוואה כזו אינה מצריכה היתר של ועדת ההיתרים.[13]

במסגרת עתירות לבג"ץ שהגישו התנועה לטוהר המידות והתנועה לאיכות השלטון הביעו שופטי בג"ץ ביקורת על ועדת ההיתרים על כך שהיא אישרה לנתניהו לקבל 270 אלף דולר למימון הגנתה של רעייתו, מבלי שדרשה חשבוניות או ראיות דומות המעידות על עלות ההליך המשפטי.[14] בהמשך פסק בג"ץ שעל נתניהו להחזיר 270 אלף דולר לעיזבונו של מיליקובסקי.[15]
