Busisiwe Mkhwebane (gebore 2 Februarie 1970) is 'n Suid-Afrikaanse politikus. Sy was die Openbare Beskermer van Suid-Afrika, wat van 2016 tot 2022 as die 4de Suid-Afrikaanse Openbare Beskermer gedien het.[1][2] President Cyril Ramaphosa het op 9 Junie 2022 in 'n skriftelike verklaring die skorsing van Mkhwebane as Openbare Beskermer met onmiddellike effek aangekondig.[3] Op 11 September 2023, na die voltooiing van die proses, het die Nasionale Vergadering gestem om Mkhwebane te verwyder as Openbare Beskermer van Suid-Afrika.

Op 16 Oktober 2023 het Mkhwebane by die Ekonomiese Vryheidsvegters-party aangesluit.[4] Sy is op 20 Oktober 2023 as parlementslid ingesweer.[5] Sy het op 16 Oktober 2024 uit die EFF en die Nasionale Vergadering bedank, 'n jaar nadat sy by die party aangesluit het.[6]

Vroeë lewe en opvoeding

Mkhwebane is op 2 Februarie 1970 in Bethal in die destydse Transvaal-provinsie (nou Mpumalanga) gebore, en het in 1988 aan die Sekondêre Skool Mkhephuli gematrikuleer. Sy studeer met 'n BProc gevolg deur 'n LLB van die Universiteit van die Noorde (nou die Universiteit van Limpopo). Sy het daarna 'n diploma in korporatiewe reg en 'n hoër diploma in belasting aan die Randse Afrikaanse Universiteit (nou die Universiteit van Johannesburg) verwerf.[7] In 2010 het sy 'n Meestersgraad in Besigheidsleierskap aan die Universiteit van Suid-Afrika voltooi.[8]

Loopbaan

In 1994 het Mkhwebane as 'n Openbare Aanklaer by die Departement van Justisie aangesluit, daarna vanaf 1996 as Regsadministratiewe Beampte in die Direktoraat Internasionale Aangeleenthede. In 1998 het sy as senior navorser by die Suid-Afrikaanse Menseregtekommissie aangesluit. Die volgende jaar het sy by die Openbare Beskermer se kantoor aangesluit as senior ondersoeker en waarnemende provinsiale verteenwoordiger. In 2005 het sy vertrek om by die departement van binnelandse sake aan te sluit as die direkteur vir vlugtelingsake en in 2009 waarnemende hoofdirekteur vir asielsoekersbestuur geword.

Van 2010 tot 2014 het sy as Raad vir Immigrasie en Burgerlike Dienste in Suid-Afrika se ambassade in China gewerk.[9] 'n Verslag deur die Organised Crime and Corruption Reporting Project het verklaar dat Mkhwebane se bankrekening gedurende hierdie tyd deur HSBC gemerk is vir die ontvangs van 'n VS$5000-betaling van die Guptafamilie in verband met 'n omstrede spoorwegkontrak met China South Rail.[10][11] Mkhwebane het die bewering verwerp dat sy geld van die Guptafamilie ontvang het.[12]

In 2014 het sy na Suid-Afrika teruggekeer om as direkteur van landinligting en samewerkingsbestuur by die departement van binnelandse sake te dien. Mkhwebane het daarna van Julie 2016 tot Oktober 2016 as 'n analis vir die Staatsveiligheidsagentskap gewerk voordat sy in Oktober 2016 as Openbare Beskermer aangestel is. Tydens haar aanstelling is dit bekend gemaak dat sy 'n noue verhouding met destydse president Jacob Zuma gehad het.[13]

Staat van beskuldiging

Thandi Modise, speaker van die Nasionale Vergadering, het in November 2020 voormalige konstitusionele hofregter Bess Nkabinde en senior advokate Dumisa Ntsebeza SC en Johan de Waal SC in 'n onafhanklike paneel aangestel om te oorweeg of daar prima facie-getuienis is wat daarop dui dat Mkhwebane uit haar amp onthef moet word. Die verslag is in Februarie 2021 aan die parlement oorhandig, en 'n parlementêre woordvoerder het sy bevindinge opgesom: “die paneel het tot die gevolgtrekking gekom dat daar wesenlike inligting is wat prima facie-bewyse van onbevoegdheid uitmaak en voorbeelde hiervan het die prima facie-getuienis ingesluit wat die Openbare Beskermer se oorreiking aantoon. en die oorskryding van die grense van haar bevoegdhede ingevolge die Grondwet en die Wet op die Openbare Beskermer asook herhaaldelike foute van dieselfde aard, soos verkeerde interpretasie van die wet."[14] Op 15 Maart 2021 het die Nasionale Vergadering 'n ondersoek begin na haar geskiktheid om die amp te beklee.[15][16] Op 11 September 2023, na die voltooiing van die proses, het die Nasionale Vergadering gestem om Mkhwebane te verwyder[17], wat haar die eerste hoof van 'n Hoofstuk 9-instelling maak wat in 'n staat van beskuldiging geplaas is.[18] Haar vervolging, een maand voor die einde van 'n 7-jaar nie-hernubare termyn, het haar 'n gratifikasie van tien miljoen rand verhoed waarop sy andersins geregtig sou gewees het.[19]
