Hutan adat

Hutan adat merupakan hutan yang berada dalam wilayah masyarakat hukum adat. Hutan adat dikelola oleh masyarakat secara turun menurun bermukim di wilayah geografis tertentu karena adanya ikatan asal-usul leluhur, adanya hubungan yang kuat dengan lingkungan hidup, serta adanya sistem nilai yang menetukan pranata ekonomi, politik, sosial dan hukum.[1] Dalam Undang–undang Kehutanan Nomor 41 Tahun 1999 tentang Kehutanan dan Putusan Mahkamah Konstitusi Nomor 35 Tahun 2012 telah memberikan pengertian mengenai Hutan Adat yaitu "hutan yang berada dalam wilayah masyarakat hukum adat". Hutan adat merupakan salah satu dari 5 skema perhutanan sosial.[2]

Dalam Buku Hutan Adat Wujud Masyarakat Berdaulat Bangsa Bermartabat yang ditulis oleh Yuli Prasetyo Nugroho dkk. adalah sebuah sejarah baru dalam pengelolaan Hutan di Indonesia yang ditandai dengan adanya penyerahan SK Hutan Adat di Istana pada tanggal 30 Desember 2016. Hutan Adat adalah bagian penting dari upaya perlindungan terhadap masyarakat hukum adat di Indonesia tidak saja hanya hutan adatnya tetapi juga kearifan local sekaligus juga jati diri keindonesiaan yang terdiri dari berbagai macam suku bangsa.[3][4][5]

Sepanjang tahun 2022, Kementrian Lingkungan Hidup dan Kehutanan telah menetapkan SK Hutan Adat sebanyak 105 SK Hutan Adat dengan luas 148.488.[6] Capaian ini penetapan hutan adat ini masih sangat rendah dari luas wilayah adat yang telah diregistrasi Badan Registrasi Wilayah Adat (BRWA). Hingga Desember 2022, BRWA telah melakukan registrasi sebanyak 1.167 peta wilayah adat dengan luas mencapai 21,3 juta hektar yang mencakup wilayah adat di 29 provinsi dan 142 kabupaten/kota.[6] Hal ini disebabkan oleh terhalang syarat oleh Perda Pengakuan Masyarakat Hukum Adat. Pengakuan Hutan Adat belum bisa dikeluarkan oleh KLHK apabila masyarakat adat belum memiliki Perda Pengakuan MHA di tempatnya.[7]
