Assistente da acusação

No direito processual penal brasileiro, assistente da acusação é aquele terceiro legitimado a intervir em ação penal pública, atuando como auxiliar do Ministério Público. Segundo o Código de Processo Penal brasileiro, é legitimado a atuar como assistente o ofendido, isto é, a vítima do crime,[1] ou seu representante legal. Caso o ofendido tenha falecido ou esteja ausente, poderão se habilitar como assistentes o seu cônjuge,[nota 1] ascendente, descendente ou irmão, nessa ordem.[nota 2] O assistente pode intervir no processo a partir do recebimento da denúncia até o trânsito em julgado da ação.[2]

Poderes do assistente

Dispõe o Código de Processo Penal que ao assistente será "permitido propor meios de prova, requerer perguntas às testemunhas, aditar o libelo e os articulados, participar do debate oral e arrazoar os recursos interpostos pelo Ministério Público, ou por ele próprio" (art. 271). Outros poderes, além dos listados no art. 271, são elencados pela legislação processual penal, tais como formular pedido de prisão preventiva[nota 3] e de desaforamento.[nota 4]

É controversa a possibilidade de o assistente da acusação poder recorrer contra decisão de desclassificação no Tribunal do Júri. Para alguns autores, o interesse que legitima a presença do assistente é de natureza meramente patrimonial; dessa forma, ele não teria legitimidade para recorrer contra a decisão de desclassificação, eis que esse interesse patrimonial continuará existindo, já que o processo não será extinto, mas meramente remetido à um juízo singular. Lado outro, parte da doutrina entende que o interesse do assistente é a obtenção de uma sentença justa; para essa visão, o assistente é legitimado a recorrer contra desclassificação.[3]

  1. ↑ A legislação não prevê a legitimidade do companheiro(a) para figurar como assistente da acusação. No entanto, é majoritário o entendimento de que o companheiro deve ser entendido como sucessor do ofendido para fins de assistência, já que a Constituição Brasileira de 1988 consagrou a união estável como entidade familiar (art. 226, § 3º).

    Art. 268. Em todos os termos da ação pública, poderá intervir, como assistente do Ministério Público, o ofendido ou seu representante legal, ou, na falta, qualquer das pessoas mencionadas no Art. 31.
    Art. 31. No caso de morte do ofendido ou quando declarado ausente por decisão judicial, o direito de oferecer queixa ou prosseguir na ação passará ao cônjuge, ascendente, descendente ou irmão.

    Em qualquer fase da investigação policial ou do processo penal, caberá a prisão preventiva decretada pelo juiz, a requerimento do Ministério Público, do querelante ou do assistente, ou por representação da autoridade policial.

    Se o interesse da ordem pública o reclamar ou houver dúvida sobre a imparcialidade do júri ou a segurança pessoal do acusado, o Tribunal, a requerimento do Ministério Público, do assistente, do querelante ou do acusado ou mediante representação do juiz competente, poderá determinar o desaforamento do julgamento para outra comarca da mesma região, onde não existam aqueles motivos, preferindo-se as mais próximas.
