1998年、FDAはロバスタチンを含む紅麹由来の栄養補助食品の販売を禁止した[37]。FDAは紅麹には天然のロバスタチンが含まれており、ロバスタチンを含む製品には医薬品の承認が必要であるとした[38]。その後、ユタ州連邦地方裁判所のデイル・A・キンボール判事は、コレスチンの製造元であるファーマネックス社の申し立てを認め、同製品は医薬品ではなく栄養補助食品として販売されているため、1994年の栄養補助食品健康教育法(Dietary Supplement Health and Education Act)に基づき、同局の禁止措置は違法であるとした[39]。
