רצח בלייז ברנסטין

ב-10 בינואר 2018, בלייז ברנסטין (באנגלית: Blaze Bernstein), בן 19, סטודנט בשנתו השנייה באוניברסיטת פנסילבניה, נמצא מת בפארק במחוז אורנג', קליפורניה, שמונה ימים לאחר שדווח כנעדר. בעת שנהרג הוא ביקר את משפחתו בלייק פורסט, קליפורניה.[1][2] הוא נדקר עשרים פעמים. יומיים לאחר מכן, סמואל וודוורד, אחד מחבריו לכיתה של ברנסטין בתיכון וחבר ארגון הטרור הנאו-נאצי יחידת אטומוואפן, נעצר והואשם כי רצח את ברנסטין.[3] בעוד ברנסטין היה גם הומוסקסואל מוצהר וגם יהודי, הרשויות הכריזו כי הוא היה קורבן לפשע שנאה.[4]

חייו

ברנסטין נולד ב-27 באפריל 1998 בדרום מחוז אורנג', קליפורניה, לגדעון ברנסטין, שותף הון ב-Leisure Capital Management,[5] ולז'אן פפר, עורכת דין לשעבר שפרשה מתחום המשפטים ב-2000 כדי לגדל את שלושת ילדיהם. לאחר שסיים את לימודיו בבית ספר התיכון לאמנויות של מחוז אורנג', בלייז נרשם ללימודי תואר ראשון באוניברסיטת פנסילבניה.[6]

הליכים משפטיים

השופט הראשי האשים בתחילה את וודוורד ברצח ובשימוש אישי בנשק קטלני.[7] באוגוסט 2018 נוספו לו שני אישומים של ביצוע פשע שנאה בגלל נטייתו המינית של ברנסטין.[7][8] וודוורד, שקושר לרצח בשל ראיות DNA, לא הודה באשמה.[9][10] בינואר 2019 התקיים שימוע מקדים.[11]

עורכת דינו של וודוורד הצהירה שלוודוורד יש תסמונת אספרגר ובעיות בנוגע לזהותו המינית.[12]

וודוורד, שהיה בן 20 בזמן הפשע, עומד בפני עונש מאסר עולם ללא תנאי אם יימצא אשם.[7] בתחילה הוא עמד בפני עונש מקסימלי של 26 שנות מאסר בגין אישומי הרצח והנשק, לפני הוספת האישומים בפשעי השנאה. הערבות של וודוורד נקבעה בתחילה על 5 מיליון דולר, אך בדיון בנובמבר 2018 החליט השופט לשלול את ערבות וודוורד לחלוטין, והשאיר אותו במעצר עד למשפט.[13]

עקב מגפת הקורונה, וודוורד נשאר במאסר מאז הופעתו האחרונה בבית המשפט ב-2018. משפטו היה מתוכנן להתחיל בתחילת שנת 2021,[14] אם כי בעקבות דחיות רבות הוא יועד להתקיים רק ב-15 ביולי 2022.[15][16]

ב-15 ביולי 2022, שופטת במחוז אורנג' השעתה זמנית את ההליכים הפליליים לאחר שעורכת הדין של וודוורד אמרה כי יש לה חששות לגבי כשירותו לעמוד לדין.[17] בסוף אוקטובר 2022, מומחים לבריאות הנפש מצאו את וודוורד ככשיר לעמוד לדין, ושימוע מקדים נקבע לינואר 2023.[18]

בנובמבר 2024 נגזר עליו מאסר עולם.
