ביזוי דגל

שריפת דגל ארצות הברית

השחתת דגל היא פעולה שמטרתה הפגנה של בוז, שנאה או מחאה כלפי המדינה או הארגון שדגלו מושחת. דרכים נפוצות להשחתת דגל היא שריפת הדגל, דריכה על הדגל או עשיית צרכים עליו[דרוש מקור].

איסור על ביזוי הדגל קיים במדינות רבות, ובהן ישראל. בארצות הברית קבע בית המשפט העליון של ארצות הברית שהשחתת דגל נכללת בחופש הביטוי המוגן בהתאם לתיקון הראשון לחוקת ארצות הברית, ולכן השלטון אינו רשאי למנוע אותה.[1]

בישראל

בישראל קובע חוק הדגל, הסמל והמנון המדינה: "הפוגע בכבוד דגל המדינה או בכבוד סמל המדינה, או גורם לפגיעה בכבודו, או משתמש בו באופן שיש בו כדי לפגוע בכבודו, דינו – מאסר עד שלוש שנים או כפל הקנס האמור בסעיף 61(א)(2) לחוק העונשין, התשל"ז-1977 או שני הענשים כאחד".[2] בנוסף לכך, בסעיף 3ב לחוק יסודות התקציב ניתנה לשר האוצר סמכות שלא להעביר לגוף מתוקצב וגוף נתמך כספים שהובטחו להם בתקציב המדינה, כאשר הגוף הוציא הוצאה לשם "מעשה של השחתה או ביזוי פיזי הפוגע בכבוד דגל המדינה או סמל המדינה".[3]
