Zločin

Zločin (v rokoch 1970-1990 nazývaný trestný čin[1]) je typ trestného činu, opak prečinu. Presnejšie: Zločin je úmyselný (teda nie nedbanlivostný) trestný čin, za ktorý trestný zákon ustanovuje trest odňatia slobody s hornou hranicou trestnej sadzby prevyšujúcou päť rokov. O zločin ide aj vtedy, ak v prísnejšej skutkovej podstate prečinu spáchaného úmyselne je ustanovená horná hranica trestnej sadzby prevyšujúca päť rokov. [2]

Zločin je teda závažnejší typ trestného činu; menej závažný typ trestného činu sa volá prečin.

Takéto delenie na zločiny a prečiny na Slovensku platí v súčasnej podobe od roku 2006[3]. V rokoch 1990-2005 a 1950-1970 sa v právnych predpisoch hovorilo len o trestných činoch, bez ďalšieho rozlišovania[4][5]. V rokoch 1970-1990 sa v právnych predpisoch rozlišovalo medzi trestnými činmi (=to, čo sa dnes volá zločiny) a prečinmi, pričom ale definícia prečinu bola dosť odlišná od dnešnej[1]. Pred rokom 1950 sa tak ako dnes rozlišovalo medzi zločinmi a prečinmi.
