Dan državnosti Bosne i Hercegovine praznik je koji se obilježava 25. novembra u Bosni i Hercegovini.[1] Na taj dan 1943. godine, na prvom zasjedanju ZAVNOBiH-a u Mrkonjić Gradu usvojena je Rezolucija ZAVNOBiH-a, u kojoj je izražena odlučnost naroda BiH da njihova zemlja, bude zbratimljena zajednica u kojoj će biti osigurana puna ravnopravnost svih, te ravnopravnost Narodne Republike BiH unutar jugoslavenske federacije, sa historijskim granicama koje su datirale i prije stvaranja zajedničke federacije.

Hronologija

Prvo zasjedanje ZAVNOBiH-a počelo je u Mrkonjić-Gradu 25. novembra 1943. godine u 19 sati. Završeno je iste noći, 26. novembra, u 4 sata ujutro.

Ovoj osnivačkoj skupštini prisustvovalo je 247 delegata iz svih krajeva BiH, od kojih 173 sa pravom glasa. Na prvom zasjedanju, ZAVNOBiH je formalno konstituisan kao predstavništvo Narodno-oslobodilačkog pokreta (NOP) Bosne i Hercegovine, ali je u stvarnosti i praksi djelovao kao njen najviši organ vlasti.

Odbornici su usvojili Rezoluciju ZAVNOBiH-a i Proglas narodima BiH u kojima se ističe da ubuduće BiH i njene narode u zemlji i inostranstvu, mogu zastupati i predstavljati samo ZAVNOBiH i AVNOJ.

Ovim aktima istovremeno je izražena odlučnost naroda BiH da njihova zemlja, koja nije ni srpska, ni hrvatska, ni muslimanska, nego i srpska i muslimanska i hrvatska, bude zbratimljena zajednica u kojoj će biti osigurana puna ravnopravnost svih Srba, Muslimana i Hrvata.

Na zasjedanju je izabrana delegacija od 58 članova koja će predstavljati BiH na Drugom zasjedanju AVNOJ-a (29. novembar 1943).

Zakonski osnov za Dan državnosti Bosne i Hercegovine

Zakonom o proglašenju 25. novembra Danom državnosti Bosne i Hercegovine (“Službeni list R BiH”, broj 9/95), određeno je da je 25. novembar Dan državnosti Bosne i Hercegovine.[2] Ovaj zakon proglasila je Republika Bosna i Hercegovina, nezavisna država, koja je postala država članica Ujedinjenih naroda 22. maja 1992.g.[3]

Ustav Bosne i Hercegovine (Aneks 4 Dejtonskog mirovnog sporazuma[4] ) izričito kaže da „Republika Bosna i Hercegovina, čiji će službeni naziv od sada biti „Bosna i Hercegovina“, nastavlja svoje pravno postojanje prema međunarodnom pravu kao država ". Također se navodi da "svi zakoni, propisi i sudski poslovnici koji su na snazi ​​na teritoriji Bosne i Hercegovine kada Ustav stupi na snagu ostaju na snazi".

Dakle, svi zakoni na snazi, uklj. gore navedeni "Zakon o proglašenju 25. novembra Danom državnosti Bosne i Hercegovine" ostaje na snazi, osim ako ga Parlamentarna skupština Bosne i Hercegovine ne promijeni ili modificira (što se još nije desilo).
