System prawny Grecji

System prawny Grecji – system prawa należący do typu kontynentalnego obowiązujący w Grecji. Na jego kształt duży wpływ miały prawo niemieckie i francuskie[1].

Gałęzie prawa

Konstytucja Grecji pochodzi z 1975 roku. Była trzykrotnie nowelizowana: w 1986, 2001 i 2008 roku.

Grecki Kodeks Cywilny pochodzi z 1940 roku. Na jego kształt duży wpływ miał niemiecki BGB. W pewnym zakresie greckie prawo cywilne zachowało pewne pozostałości instytucji prawa bizantyńskiego, szczególnie w postaci zasad ogólnych i klauzul generalnych. Grecki Kodeks Cywilny dzieli się na pięć części: część ogólną, prawo zobowiązań, prawo rzeczowe, prawo rodzinne i prawo spadkowe[2].

Wzorce prawa handlowego zostały natomiast wzorowane na prawie francuskim. W 1828 r. Grecja przyjęła napoleoński Code de commerce z 1807 r. Chociaż formalnie obowiązuje on do dzisiaj, to z powodu wielu nowelizacji, niewiele w nim pozostało z dawnej kodyfikacji[3].

Prawo karne oparte jest na Kodeksie Karnym i Kodeksie Postępowania Karnego z 1950 r. Wcześniejsze kodyfikacje (Kodeks Karny z 1833 r. i Kodeks Postępowania Karnego z 1834 r.) były oparte na prawie bawarskim, a ich podstawy zostały opracowane przez bawarskiego prawnika Georga Ludwiga von Maurera[1].

Oficjalnym wydawnictwem publikującym akty prawne jest Efimerida tis Kiwerniseos.

Sądownictwo

Sądownictwo dzieli się na dwie gałęzie: cywilną (obejmującą sądy cywilne i karne) i administracyjną.

W sądownictwie cywilnym, na najniższym poziomie są sądy pokoju, rozpatrujące sprawy drobne. Ponad nimi są sądy pierwszej instancji. Odwołania od nich rozpatrują sądy apelacyjne, których jest w całym kraju 14. Na szczycie hierarchii sądowej stoi Sąd Kasacyjny (Άρειος Πάγος, Arios Pagos) z siedzibą w Atenach.

W sprawach administracyjnych najwyższym sądem jest Rada Stanu (Συμβούλιο της Επικρατείας, Simwulio tis Epikratias), utworzona w 1928 r. Organ ten został ukształtowany na wzór francuskiej Rady Stanu (Conseil d’Etat).

Trzecim najwyższym organem sądowym jest Trybunał Obrachunkowy (Ελεγκτικό Συνέδριο, Elengtiko Sinedrio) zajmujący się kontrolą wydatków publicznych i odpowiedzialnością wojskowych i funkcjonariuszy publicznych. Kontrola konstytucyjności prawa ma charakter rozproszony - nie jest powierzona odrębnemu sądowi konstytucyjnemu, lecz wchodzi w zakres kompetencji sądów powszechnych[4].

Edukacja prawnicza

Zgodnie z art. 16 Konstytucji Grecji edukacja na poziomie wyższym może być prowadzona tylko przez uczelnie publiczne. Jedynie więc na takich uczelniach kształci się prawników. Obecnie istnieją trzy wydziały studiów prawniczych: na Uniwersytecie w Atenach, Salonikach i w Komotini[5]. Studia trwają cztery lata.
