Trykkefrihet

Trykkefrihet i verden 2024 ifølge Reportere uten grenser. Rød og oransje farger viser land med streng pressesensur, mens land merket med grønt og blått har større ytringsfrihet for aviser, bøker og magasiner.

Trykkefrihet er en del av ytringsfriheten og innebærer rett til å trykke og spre informasjon og oppfatninger fritt. Trykkefrihet er en av demokratiets grunnleggende egenskaper. Hver innbygger i en stat hvor trykkefrihet råder har rett til å spre sine oppfatninger i pressen så lenge de ikke bryter mot noen annen lov der innholdet begrenser trykkefriheten. Trykkefriheten får likevel ifølge de demokratiske prinsippene ikke innskrenkes mer enn hva som kreves for å beskytte andre rettigheter.

3. mai hvert år feires den Internasjonale dagen for pressefrihet, innstiftet av FN.

Norges Grunnlov slik den ble vedtatt 17. mai 1814 inneholdt en § 100 om trykke- og ytringsfrihet:

Trykkefrihed bør finde Sted. Ingen kan straffes for noget Skrift af hvad Indhold det end maatte være, som han har ladet trykke eller udgive, medmindre han forsætligen og aabenbar enten selv har viist, eller tilskyndet andre til Ulydighed mod Lovene, Ringeagt mod Religionen, Sædelighed eller de constitutionelle Magter, Modstand mod disses Befalinger, eller fremført falske og ærekrænkende Beskyldninger mod nogen. Frimodige Yttringer om Statsstyrelsen og hvilkensomhelst anden Gjenstand ere Enhver tilladte.

Trykkefriheten avgrenses blant annet av straffeloven. Berge-dommen fra 2012 førte til en debatt om publikasjoner på internett skal regnes som trykte medier etter straffelovens daværende § 10.[1]
