Grønlands rettsvesen

Grønlands rettsvesen skiller seg på flere måter markant fra rettsvesenet i andre land. På Grønland er kretsdommeren, meddommere og forsvarere lokale legfolk og ikke jurister. Først når en sak kommer for appellretten, Grønlands Landsret, opptrer juridisk utdannede anklagere, dommere og advokater. Rettsvesenet er dobbeltspråklig idet der tales og skrives både grønlandsk og dansk. Grønland har heller ikke et straffesystem slik man kjenner fra vestlige land. Dommeren i en kriminalsak har et bredt utvalg av tiltak å velge mellom i en straffelov uten strafferammer. Anstaltene for domfelte er åpne, og de innsatte må – så vidt mulig – arbeide utenfor anstalten.

Siden rammene for det nåværende rettsvesenet ble utformet kort etter annen verdenskrig, har det grønlandske samfunnet gjennomgått en nærmest eksplosiv og ganske voldsom utvikling. Samfunnet er nå langt mere komplisert enn dengang, hvilket blant annet viser seg ved en stadig mere omfattende og komplisert lovgivning, som stiller økte krav til rettsvesenets faglige ekspertise. Samtidig er der skjedd en konsentrasjon av befolkningen i byene, og de gamle familiemønstre er endret samtidig med en intensiv næringsutvikling. Derfor var det en markant økning i den registrerte kriminaliteten frem til 1980-årene, hvoretter kriminaliteten generelt har vært fallende, dog således at grove voldshandlinger, sedelighetskriminalitet og drap er relativt hyppig forekommende forbrytelser.

Under hensyn til de endrede samfunnsforhold nedsatte den danske regjeringen og Grønlands hjemmestyre i 1994 Den Grønlandske Retsvæsenskommision. Hovedoppgaven for kommisjonen, som avleverte sin Betænkning om Det grønlandske retsvæsen ti år senere, var å foreta en grundig gjennomgang og en nyvurdering av hele det grønlandske rettsvesenet og på dette grunnlag å fremsette forslag til hvordan der kan skje en – eventuelt gjennomgripende – revisjon av rettsvesenet på Grønland.

Kommisjonens betenkning var per januar 2012 til behandling i det politiske system.
