עמוס דב האוזנר (נולד ב-22 ביוני 1950) הוא עורך דין ישראלי, המכהן כיו"ר המועצה הישראלית למניעת עישון וכחבר בוועד המנהל של מכון משואה. בעבר כיהן כחבר בית הדין העליון של ההסתדרות הציונית העולמית, כפרקליט ההסתדרות הציונית העולמית וכיועץ המשפטי של ההסתדרות הציונית העולמית.

ביוגרפיה

נולד בירושלים בשנת 1950 ליהודית ולגדעון האוזנר, לימים היועץ המשפטי לממשלה, ראש התביעה במשפט אייכמן, חבר כנסת ושר. כנער, התנדב האוזנר בבית חולים בירושלים, מטעם ארגון נוער לנוער (1966–1968). למד משפטים באוניברסיטה העברית בירושלים, כשבמהלך לימודיו היה חבר במערכת משפטים (כתב עת)[1] ועוזר מחקר בשנים 1975–1976. בשנת 1976, סיים את לימודי המשפטים.[2] לאחר סיום לימודיו השתלם במשרד עורכי דין בניו יורק בשנים 1977–1978 ועם חזרתו לישראל הצטרף למשרד עורכי דין של אביו בירושלים, בו הוא נכון ל-2021, עדיין פעיל.

במקביל לעבודתו, כיהן כחבר בית הדין הציוני העליון של ההסתדרות הציונית העולמית בשנים 1998–2006, כפרקליט ההסתדרות הציונית העולמית בשנים 2006–2010[3] וכיועצה המשפטי בשנים 2009–2010.[4]

בנוסף, כיהן בהתנדבות כיו"ר של ועדות בחירות למנהלים קהילתיים בירושלים בשכונות נווה יעקב, הר נוף, תלפיות מזרח, גילה, חומת שמואל וגינות העיר בשנים 1997–2012.[5]

האוזנר חבר בוועד המנהל של מכון משואה מאז 2011,[6] וכן מרצה בנושא משפט אייכמן.[7][8]

פעילות ציבורית למניעת עישון

האוזנר החל את פעילותו בנושא מניעת עישון בשנת 1983, עת התקבל החוק למניעת עישון במקומות ציבוריים בישראל.[9] באותה שנה, הצטרף כיועץ משפטי לאגודה למניעת עישון.

בשנת 1985, יזם האוזנר אי הכרה בהוצאות לפרסום מוצרי עישון לצורכי פטור ממס.[10]

במסגרת פועלו באגודה למניעת עישון, יזם תשדירי שירות בטלוויזיה נגד העישון תוך שימוש במוטו "סיגריה זה מגעיל אותי".[11] אחד מהתשדירים בתחילת שנות ה-90 שעשו שימוש במוטו זה, הופק על ידי אייל פלד בשיתוף הגרפיקאי ששון גואטה, והציג באופן פרובוקטיבי סיגריות שבהדרגה הופכות לתולעים.[12] באותה תקופה, עורר התשדיר זעזוע ציבורי.[13]

כעורך דין אקטיביסט, עתר האוזנר מספר פעמים לבג"ץ בנושאים הקשורים לסיגריות ועישון. בשנת 1987, עתר למניעת הופעה של פרסומות לסיגריות בעיתון הצבאי במחנה, כשבעקבות העתירה הפרסום הופסק.[14] בשנת 1988, עתר למניעת מימון המדינה להקמת מפעל לייצור סיגריות. עקב התמשכות הדיון ודחיית המימון, נבלמה הקמת המפעל.[15][16] בינואר 1991, כתוצאה מעתירה לבג"ץ, נמנע שידור בטלוויזיה של משחקי כדורסל בהם נראית פרסומת לסיגריות. בעקבות הצלחת עתירה זו, הופסקה הפרסומת גם במשחקי כדורגל.[17][18] בשנת 1996, עתר לבג"ץ למניעת עישון בטיסות לישראל וממנה. בעקבות הצלחת העתירה, הפכה מדינת ישראל בשנת 1998 לחלוצת יישום איסור כזה בעולם.[19]

מתחילת העשור הראשון של המאה ה-21, מכהן האוזנר כיו"ר המועצה הישראלית למניעת עישון. בשנת 2000, התקבל על ידי הכנסת חוק המחייב את שר הבריאות להגיש מדי שנה לכנסת דו"ח בדבר מצב העישון העדכני בישראל ופעולות שננקטו למניעת העישון באותה שנה.[20] בשנת 2007, פעל במסגרת תפקידו כיו"ר המועצה מול ח"כ גלעד ארדן להחמרת החקיקה כנגד בתי עסק ומקומות ציבוריים שאינם פועלים למניעת עישון באזורים אסורים בתחומם.[21]

בשנים 2003–2015 היה חבר בוועדת FAMRI (אנ'), ארגון שתמך כספית במחקרים מדעיים העוסקים בנזקי העישון.

במהלך דרכו, השיג מספר תקדימים משפטיים הנוגעים למניעת עישון במקומות ציבוריים. בשנת 2006 השיג האוזנר תקדים, המאפשר למי שנחשף לעישון במקום ציבורי בניגוד לחוק, לקבל פיצוי מבעל המקום או המחזיק בו.[22] בשנת 2010, השיג האוזנר תקדים נוסף למניעת עישון בתיאטרון, גם אם מתבצע כחלק מהצגה.[23] בשנת 2011, השיג אישור מבתי המשפט להכרה בתביעות ייצוגיות בגין מניעת עישון במסעדות ומועדונים, ברים ובריכות שחייה.[24][25]

בשנת 2012, יזם האוזנר הגדרה של תעשיית הסיגריות כעוסקת בפשע נגד האנושות, בנאומו בבניין האו"ם במסגרת התכנית להנצחת זכר השואה.[26] כמו כן, קרא להעמיד לדין פלילי חברות סיגריות בגין המתה.[27]

במסגרת פועלו, מרצה האוזנר בפני הציבור על נזקי העישון ומניעת העישון.[28][29]
