אחריות להגן

אחריות להגן (מקוצר על פי ראשי התיבות באנגלית לR2P או RtoP) הופיעה כיוזמה לראשונה בדו"ח של הוועדה הבינלאומית להתערבות וריבונות מדינית (ICISS) שפורסם בשנת 2001[1]. לאחר-מכן, בשנת 2004 הופיעה לראשונה באג'נדה של האומות המאוחדות כחלק מהדו"ח הקרוי: "A More Secure World: Our Shared Responsibility" (בתרגום חופשי: "עולם בטוח יותר: האחריות המשותפת שלנו"). יש לציין שהיוזמה, בשימושה על ידי האו"ם, שונתה במקצת ואינה כוללת את הדיון שנעשה בוועדה הבינלאומית להתערבות וריבונות מדינית באשר ליחס הקהילה הבינלאומית להתערבות במעשי זוועה, כאשר מועצת הביטחון נכשלת מלעשות כן[2]. היא מבוססת על נורמה מתעוררת, או סט של עקרונות, המבוססים על הרעיון של הריבונות לא כזכות-יתר אלא כאחריות. R2P מתמקדת במניעה של ארבעה פשעים עיקריים: רצח עם, פשעי מלחמה, פשעים נגד האנושות, וטיהור אתני. פשעים אלה נכנסים תחת מונח המטריה פשעי זוועה המוניים (Mass Atrocity Crimes).

האחריות להגן נשענת על שלושה "עמודים":

  1. למדינה אחריות להגן על אזרחיה מזוועה המונית.
  2. לקהילה הבינלאומית אחריות לסייע למדינה שלא מצליחה להגן על אזרחיה בעצמה.
  3. אם המדינה לא מגנה על אזרחיה מפני זוועה המונית ומוצו כל האמצעים המכוונים לשימוש בדרכי-שלום, לקהילה הבינלאומית אחריות להתערב באמצעות אמצעי כפייה כגון סנקציות כלכליות. פעולה צבאית תיחשב למוצא אחרון ובתנאי שמועצת הביטחון תאשר אותה כהחלטה מכח פרק 7 למגילת האומות-מאוחדות.

בקהילה הבינלאומית R2P היא נורמה, לא חוק. היא מספקת מסגרת לשימוש בכלים קיימים כגון תיווך, מנגנוני התרעה מוקדמת, סנקציות כלכליות והיכולות הנובעות מפרק 7 באמנת האומות המאוחדות על מנת למנוע זוועות המוניות. מדינות, ארגוני החברה האזרחית, ארגונים מקומיים ומוסדות בינלאומיים כולם משחקים תפקיד בתהליך R2P. הסמכות לנקוט במוצא האחרון ולהתערב צבאית דורש את החלטת מועצת הביטחון של האו"ם והעצרת הכללית.
