Territorio histórico

Territorio histórico (en éuscaro foru lurralde ou lurralde historiko) é a denominación que se usa na comunidade autónoma do País Vasco (España), dentro do seu ordenamento xurídico interno, para cada unha das tres entidades territoriais que a integran: Áraba, Biscaia e Guipúscoa. Os territorios históricos coinciden, nos seus actuais límites, coas provincias do mesmo nome:

Os territorios históricos están rexidos por Deputacións Forais, as cales exercen non só as competencias ordinarias dunha deputación provincial, senón tamén competencias propias do réxime foral como, por exemplo, en materia fiscal, e por Xuntas Xerais, órganos lexislativos facultados para aprobar normas e regulamentos forais. Cada Xunta Xeral está composta por 51 membros, elixidos por sufraxio universal en cada territorio.

O recoñecemento constitucional desta singularidade dos territorios históricos, do mesmo xeito que a da Comunidade Foral de Navarra, deriva da disposición adicional primeira da Constitución española (aínda que a Constitución alude a "territorios forais", o Estatuto de Autonomía para o País Vasco adopta a expresión "territorios históricos"):

A Constitución ampara e respecta os dereitos históricos dos territorios forais. A actualización xeral de devandito réxime foral levarase a cabo, no seu caso, no marco da Constitución e dos Estatutos de Autonomía.

A disposición adicional primeira da Constitución, o Estatuto de Autonomía do País Vasco e a Lei de Territorios Históricos (Lei 27/1983, de 25 de novembro, de Relacións entre as Institucións Comúns da Comunidade Autónoma e os Órganos Forais dos seus Territorios Históricos) aprobada polo Parlamento Vasco constitúen o marco xurídico básico destes entes territoriais forais.

Tamén se lles chama territorios históricos aos sete territorios que, segundo a Euskaltzaindia, coa denominación oficial en castelán en cursiva (aprobada polas cortes xerais españolas), e o nacionalismo vasco, compoñerían a chamada Euskal Herria (Áraba -en éuscaro, Araba-, Biscaia -Bizkaia-, Guipúscoa -Gipuzkoa-, que conforman a autonomía do País Vasco, e Navarra -Nafarroa-, en España; e Baixa Navarra -Nafarroa Beherea-, Lapurdi e Zuberoa, en Francia).[1][2]
