Ustav Jugoslavije iz 1963.

Ustav SFR Jugoslavije od 1963. godine[1] nastao je kao rezultat uvjerenja vladajućih struktura Jugoslavije da su samoupravni odnosi u dovoljnoj mjeri prevladali u društvu da zavređuju novo i konačno ustavnopravno definiranje i ustoličavanju.

Odredbe

Definiciju države karakterizira ne samo odredba da je to savezna država, već i socijalistička demokratska zajednica, što je trebalo da označi težnju ka marksističkom idealu o odumiranju države. Osnovima ekonomskog uređenja proglašeni su društvena svojina, samoupravljanje i samoorganiziranje radnih ljudi na mikro i makro planu. Pravo na društveno samoupravljanje proglašeno je neprikosnovenim, a teritorijalne jedinice u državi (općina, srez, autonomne pokrajine SR Srbije, Socijalističke republike i sama federacija) proglašene su društveno-političkim zajednicama. U odredbi nezabilježenoj u ustavnom pravu, ukinuta je hijerarhija između ovih jedinica i uveden sistem međusobnih prava i obaveza. Skupština je proglašena najvišim organom vlasti i društvenog samoupravljanja, a u saveznu i republičke skupštine su pored općepolitičkog vijeća uvedena i vijeća radnih zajednica - privredno, prosvjetno-kulturno, socijalno-zdravstveno i organizacijsko-političko. Skupštine autonomnih pokrajina mogle su imati i više. Predsjednik republike postao je neovisan od SIV-a i samostalni organ federacije. Uveden je Ustavni sud Jugoslavije i ustavni sudovi republika članica.

Praksa

Na ovaj Ustav donijeto je 42 amandmana do donošenja novog Ustava Jugoslavije od 1974. godine. Ovo pokazuje da stabilnost institucija nije bila postignuta na duži rok. Novi amandmani ojačali su položaj autonomnih pokrajina, uveli nove oblasti samoupravljanja a dotadašnji savezni organi postali su zajednički , a ne više nadređeni.
