L'Estáu d'alarma ye un réxime escepcional que se declara p'asegurar el reestablecimientu de la normalidá de los poderes nuna sociedá democrática.

España

El Gobiernu, n'usu de les facultaes que-y da l'artículu 116.2 de la Constitución, puede declarar l'estáu d'alarma, en tou o parte del territoriu nacional, cuando se produza dalguna de les siguientes alteraciones graves de la normalidá:

  • Grave riesgu, catástrofe o calamidá pública, tales como terremotos, hinchentes, quemes urbanes y forestales o accidentes de gran magnitú.
  • Crisis sanitaries, tales como epidemies y situaciones de contaminación graves.
  • Situaciones de desabastecimiento de productos de primera necesidá.
  • Paralización de servicios públicos esenciales pa la comunidá y allegue dalguna de les circunstancies o situaciones anteriores.

L'estáu d'alarma ye declaráu pol Gobiernu por aciu decretu alcordáu en Conseyu de Ministros por un plazu máximu de 15 díes, dando cuenta al Congresu de los Diputaos, axuntáu darréu al efeuto y ensin que la so autorización nun va poder ser prorrogáu dichu plazu, y va establecer l'algame y condiciones vixentes mientres la prórroga. El decretu va determinar l'ámbitu territorial a que s'estienden los efeutos de la declaración.

Llimitación de los derechos al traviés de Decreto-Ley. Reguláu nel art. 55 de la Constitución Española.

  • Podrá llindase la circulación o permanencia de persones o vehículos n'hores y llugares determinaos, o les condiciona al cumplimientu de ciertos requisitos.
  • Podrá practicase requisas temporales de too tipu de bienes ya imponer prestaciones personales obligatories.
  • Podrá intervenise y ocupar transitoriamente industries, fábriques, talleres, esplotaciones o locales de cualquier naturaleza, dando cuenta d'ello a los Ministerios comenenciudos.
  • Podrá llindase o racionar l'usu de servicios o'l consumu d'artículos de primera necesidá.
  • Podrá impartise les órdenes necesaries p'asegurar el suministru de los mercaos y el funcionamientu de los servicios y de los centros de producción afeutaos.

El sábadu 4 d'avientu de 2010, a les 12:30 hores, el Gobierno d'España declara per primer vegada dende la entrada del orde democráticu nel país, l'estáu d'alarma en tol territoriu nacional con motivu del zarru del espaciu aereu por cuenta de la fuelga de controladores. El gobiernu amparar en qu'esti yera un serviciu públicu básicu, y que se taben produciendo unos graves perxuicios a los ciudadanos y a la economía del país.

Viéronse afeutaes más de 600.000 persones, lo que supunxo una perda de negociu pa les empreses dedicaes al turismu. Polo que'l Gobiernu, amparándose nel artículu 11 de la Llei Orgánica 4/1981 de 1 de xunu, de los estaos d'alarma, esceición y sitiu; movilizó a los controladores aéreos, pasando a tar consideraos como personal militar mientres durara dichu estáu, provocando que si nun retornaren al trabayu enfrentárense a fuertes penes de cárcel por desobedecer les órdenes d'un mandu militar y por deserción.
