Kejahatan perang Israel adalah pelanggaran hukum pidana internasional, termasuk kejahatan perang dan kejahatan terhadap kemanusiaan, yang dilakukan oleh Pasukan Israel, cabang militer negara Israel sejak berdirinya Israel pada tahun 1948.[1]

Hal ini termasuk penargetan dan pembunuhan warga sipil dengan sengaja, pembunuhan tawanan perang dan kombatan yang menyerah , serangan tanpa pandang bulu, hukuman kolektif, kelaparan warga sipil, penggunaan tameng manusia, penyiksaan, pemindahan paksa, pelanggaran netralitas medis, penargetan jurnalis, pelanggaran hukum. serangan udara atau serangan terhadap objek sipil dan objek yang dilindungi, perusakan yang tidak disengaja, dan hasutan untuk melakukan genosida. Di hadapan hukum internasional, Israel diharuskan bertanggung jawab atas setiap serangan terhadap warga sipil dan fasilitas-fasilitas berdasarkan hukum internasional. Israel meratifikasi Konvensi Jenewa pada tanggal 6 Juli 1951,[2] dan pada tanggal 2 Januari 2015, Negara Palestina menyetujui Statuta Roma, memberikan yurisdiksi Mahkamah Pidana Internasional atas kejahatan perang yang dilakukan di Wilayah teritorial Palestina.[3]

Pakar hak asasi manusia berpendapat bahwa tindakan yang dilakukan Pasukan Israel selama konflik bersenjata di teritorial Palestina termasuk dalam rubrik kejahatan perang.[4] Laporan eksekutif dari Perserikatan Bangsa-Bangsa, Human Rights Watch, Médecins Sans Frontières, Amnesty International, dan pakar hak asasi manusia menyampaikan bahwa Israel melakukan kejahatan perang.[5]

Sejak tahun 2006, Dewan Hak Asasi Manusia telah mengamanatkan beberapa misi pencarian fakta mengenai pelanggaran hukum internasional, termasuk kejahatan perang, di teritorial Palestina termasuk penyelidikan permanen dan berkelanjutan sejak Mei 2021.[6][7] Sejak tahun 2021, Mahkamah Pidana Internasional telah mengamanatkan beberapa misi pencarian fakta mengenai pelanggaran hukum internasional, termasuk kejahatan perang, di teritorial Palestina. melakukan penyelidikan aktif terhadap kejahatan perang Israel yang dilakukan di teritorial Palestina.[8] Untuk mengadili kejahatan perang ini, otoritas hukum yang bisa melakukannya ialah Mahkamah Pidana Internasional (International Criminal Court [ICC]). ICC punya kapasitas untuk melakukan penyelidikan terkait genosida, kejahatan perang, serta kejahatan terhadap kemanusiaan.
