Hak reklame


Menurut Pasal 1145 KUH Perdata, hak reklame ialah hak yang diberikan kepada penjual untuk menuntut pengembalian barang jualan yang masih ada di tangan pembeli.[1] Menurut Dorhout Mess, hak reklame adalah upaya pemecahan perjanjian timbal balik secara sepihak, karena dengan berhasilnya penjual melaksanakan hak reklamenya, pecahlah perjanjian jual-beli bersifat timbal-balik dengan sedirinya.[2]

Pengaturan

Pengaturan mengenai hak reklame ada dalam:

  1. Pasal 1145, Pasal 1146, dan Pasal 1146a KUH Perdata, mengenai hak reklame diluar kepailitan;
  2. Pasal 230 sampai dengan Pasal 239 KUH Dagang, terkait hak reklame dalam kepailitan.

Syarat

  • Syarat-syarat hak reklame di luar kepailitan di antaranya:
  1. Penjualan terkait benda bergerak harus bersifat tunai;
  2. Benda yang sudah diserahkan maka harus masih berada di tangan pembeli dan masih harus dalam keadaan yang dama dengan keadaan semula saat penyerahan hal ini sesuai dengan Pasal 231 KUH Dagang bsd Pasal 1145 ayat (2) KUH Perdata); dan
  3. Tenggang dari pelaksanaan hak reklame adalah 30 hari setelah penyerahan tercantum dalam Pasal 1145 KUH Perdata).[1]
  • Syarat-syarat hak reklame dalam kepailitan di antaranya:
  1. Pembeli tersebut lalai dalam membayar harga beda yang sudah dibelinya, lalu jatuh dalam keadaan pailit.
  2. Tidak perlu menghiraaukan mengenai benda bersangkutan tersebut dijual dengan tunai ataupun cicilan, asal benda sudah diserahkan kepada pembeli yang jatuh pailit itu, walaupun benda masih dalam perjalanan baik di darat maupun di laut (Pasal 232 ayat (1) KUHD)
  3. Tenggang pelaksanaan hak reklame 60 hari terhitung mulai penyimpangan benda itu terhadap si pailit atau pada pihak ketiga bagi si pailit (Pasal 232 ayat (2) KUHD).
  4. Benda yang sudah dibeli tinggal sebagaian saja ditempat si pailit, maka pengembalian seimbang dengan benda yang direklamir (Pasal 234 KUHD).
  5. Penjual yang mereklamir benda telah dijualnya, dibebani dengan semua biaya telah dikeluarkan si pailit bagi pemeliharaan benda yang direklamir itu (Pasal 235 KUHD).[3]
