Hak penguasaan atas tanah adalah berisikan didalamnya terdapat wewenang, kewajiban dan/atau larangan bagi pemegang haknya untuk berbuat sesuatu dengan tanah yang dihaki. “Sesuatu” yang boleh, wajib dan/atau dilarang untuk diperbuat itulah yang merupakan tolak pembeda antara berbagai hak penguasaan atas tanah yang diatur dalam Hukum Tanah negara yang bersangkutan.[1]
Hierarki hak penguasaan atas tanah dalam Hukum Tanah Nasional menurut santoso diantaranya:[2]
Sesuai Pasal 33 ayat (3) UUD 1945 maka Hak Bangsa Indonesia atas tanah merupakan hak penguasaan atas tanah tertinggi karena mencakup semua tanah yang ada di dalam wilayah negara, yang merupakan tanah bersama, bersifat abadi dan menjadi induk bagi hak-hak penguasaan yang lain atas tanah yang tercantum dalam Pasal 1 ayat (1) sampai dengan ayat (3) UUPA.
Hak menguasai dari Negara atas tanah bersumber pada Hak Bangsa Indonesia atas tanah, yang hakikatnya merupakan penugasan pelaksanaan tugas kewenangan bangsa yang mengandung unsur publik. Tugas mengelola seluruh tanah bersama tidak mungkin dilaksankana sendiri oleh seluruh Bangsa Indonesia, maka dalam penyelenggaraannya, Bangsa Indonesia sebagai pemegang hak dan pengemban amanat tersebut, pada tingkatan tertinggi dilaksanakan oleh Negara Republik Indonesia sebagai organisasi kekuasaan seluruh rakyat hal ini susuai dalam Pasal 2 ayat (1) UUPA.[3]
Sesuai Pasal 3 UUPA bahwa “ Dengan mengingat ketentuan-ketentuan dalam pasal 1 dan 2 pelaksanaan hak ulayat dan hak-hak yang serupa itu dari masyarakat-masyarakat hukum adat, sepanjang menurut kenyataannya. Masih ada, harus sedemikian rupa sehingga sesuai dengan kepentingan nasional dan Negara, yang berdasarkan atas persatuan bangsa serta tidak boleh bertentangan dengan undang-undang dan peraturan-peraturan yang lebih tinggi.
